Terms of Service
These Terms of Service govern your use of RAMS-flow, operated by RAMS-FLOW LIMITED trading as RAMS-flow, a company registered in England and Wales (Company No. 17454027).
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
1. About the Service
RAMS-flow is a software tool that enables users to create, manage and store Risk Assessments and Method Statements (RAMS) and associated health and safety documentation. The Service includes features powered by artificial intelligence that assist in drafting risk assessment content.
2. Important Disclaimer — Not Professional Advice
2.1 RAMS-flow is a document creation tool. Nothing produced by or within the Service constitutes professional health and safety advice, legal advice, or a recommendation of any kind.
2.2 AI-generated content within the Service is produced by automated systems. It is a starting point for your own documentation only. It has not been prepared by a qualified health and safety professional and must not be treated as such.
2.3 All content generated, drafted, or suggested by the Service — including but not limited to risk assessments, method statements, hazard identification, control measures, and any other documentation — must be thoroughly reviewed, verified, and adapted by a competent person before it is used, relied upon, or submitted to any third party.
2.4 A competent person means an individual with sufficient training, experience, knowledge, and other qualities to enable them properly to assist in undertaking the measures required under the relevant health and safety legislation.
2.5 We make no warranty, representation, or guarantee — express or implied — that any content generated by the Service is accurate, complete, suitable, legally compliant, or fit for any particular purpose.
3. Your Legal Obligations
3.1 Under the Health and Safety at Work etc. Act 1974, every employer has a duty to ensure, so far as is reasonably practicable, the health, safety and welfare of all employees and others who may be affected by their work activities.
3.2 Under Regulation 3 of the Management of Health and Safety at Work Regulations 1999, every employer is required to make a suitable and sufficient assessment of the risks to the health and safety of their employees and others arising from their work activities. This is a legal obligation that rests entirely with you as the employer or person in control of the work activity.
3.3 RAMS-flow is a tool to assist you in meeting this obligation — it does not fulfil it on your behalf. The legal duty to carry out, review, and act upon risk assessments remains with you at all times, regardless of how the documentation was produced.
3.4 You are reminded that:
- (a) A risk assessment must be suitable and sufficient for the specific activity, workplace, and workforce — a generic or AI-generated document that has not been reviewed and adapted is unlikely to meet this standard;
- (b) Risk assessments must be reviewed regularly and whenever there is reason to suspect they are no longer valid;
- (c) The findings of risk assessments must be implemented;
- (d) Employees and other relevant persons must be informed of the risks identified and the measures in place to control them;
- (e) Where five or more employees are employed, risk assessments must be recorded in writing.
3.5 Failure to comply with these obligations may constitute a criminal offence under UK health and safety legislation and may result in enforcement action by the Health and Safety Executive (HSE) or local authority.
3.6 RAMS-flow accepts no responsibility for your compliance or non-compliance with any legal obligation. Use of this Service does not constitute legal compliance.
4. Your Responsibilities
4.1 You are solely responsible for:
- (a) Reviewing all AI-generated and platform-assisted content before use;
- (b) Ensuring all documentation produced using the Service is suitable and sufficient for your specific workplace, task, environment, and workforce;
- (c) Adapting all content to reflect actual site conditions, equipment, personnel, and working practices;
- (d) Ensuring all documentation complies with applicable health and safety legislation;
- (e) Obtaining independent professional advice where required;
- (f) Communicating completed risk assessments and method statements to all relevant persons before work commences;
- (g) Reviewing and updating documentation regularly and whenever there is a significant change.
4.2 You confirm that you are competent, or have access to a competent person, to review and validate all documentation produced using the Service before it is used.
4.3 You must not submit, use, or rely upon any documentation produced by the Service without first reviewing and satisfying yourself that it is accurate, complete, and appropriate for your specific circumstances.
5. Limitation of Liability
5.1 To the fullest extent permitted by applicable law, we exclude all liability for:
- (a) Any injury, illness, death, or harm to any person arising from use of or reliance upon documentation produced using the Service;
- (b) Any loss, damage, claim, liability, cost, or expense arising from your use of the Service or any documentation produced by it;
- (c) Any failure of AI-generated content to identify hazards, risks, or control measures relevant to your specific circumstances;
- (d) Any inaccuracy, error, or omission in content produced by the Service;
- (e) Any regulatory, legal, or enforcement action arising from use of documentation produced by the Service.
5.2 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our own negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
5.3 Where liability cannot be fully excluded, our total aggregate liability to you shall not exceed the total fees paid by you to us in the twelve months preceding the event giving rise to the claim.
6. AI-Generated Content
6.1 You acknowledge and agree that:
- (a) AI-generated content is produced by automated systems and may contain errors, omissions, or content that is inappropriate or unsuitable for your circumstances;
- (b) AI systems do not have knowledge of your specific workplace, workforce, equipment, working practices, or site conditions;
- (c) AI-generated content must always be treated as a draft starting point and not as a completed, authorised, or validated document;
- (d) You will not use AI-generated content without first applying your own professional judgement and the judgement of a competent person;
- (e) Generating a document using the Service does not constitute compliance with any legal obligation to carry out or record a risk assessment.
